The Documents That Govern the Airpark

Western Sky Airpark was created as an aviation-related residential community. The Declaration of Covenants, Conditions and Restrictions, together with its 2018 First Amendment, is what protects that purpose — the runway, the hangar-first character of the lots, and the property values of every owner. Both instruments are recorded in the Official Records of La Paz County, Arizona and are binding on every lot and every owner.

Declaration of Covenants, Conditions and Restrictions

The founding declaration for the Western Sky Airpark Subdivision. Originally recorded November 3, 2004 and re-recorded January 24, 2005 for the sole purpose of adding the Exhibit “A” legal description. This re-recorded copy contains the complete original Declaration.

Amendment · Currently in Effect

First Amendment to the Declaration

Adopted May 3, 2018 by not less than 75% of lot owners under Section 17 of the Declaration, and recorded June 6, 2018. The Amendment replaces portions of Section 2 (Use of Property), including hangar and dwelling standards, and must be read together with the Declaration.

What the CC&Rs Cover

Use of Property

Residential lots are single-family. One permanent dwelling and one recreational vehicle per lot; an occupied RV must be fully inside a compliant hangar. Lots C-1 through C-14 are designated commercial (C-2).

Hangar & Dwelling Standards

The 2018 Amendment sets minimum hangar dimensions, eave heights, and bifold door requirements, along with minimum dwelling width and square footage. A conforming hangar is central to the airpark’s character.

Architectural Committee

Plans for structures and improvements are reviewed by the Architectural Committee established under Section 3 of the Declaration before construction begins.

Airport Facilities

The runway, primary surface, taxiways, and roadways are common area maintained by the Association and must remain accessible for improvement and maintenance at all times.

Aviation Fuel

Commercial fuel sales are limited to a fixed base operator lot. Owners may store fuel on their lot only for private use in their own aircraft, within the limits stated in the Declaration.

The Association

Every lot carries one automatic membership in the Western Sky Airpark Association with one vote per lot. The Association owns and maintains the common areas, levies assessments, and enforces the Declaration.
