Terms of Use & Conditions of Sale

These Terms of Use and Conditions of Sale (the "Terms") are a binding agreement between Western Sky Airpark Development LLC, an Arizona limited liability company ("Western Sky Airpark", "we", "us", or "our"), and you ("you" or "your"). They govern your access to and use of www.westernskyairpark.com (the "Site"), your reservation or purchase of our properties, sites, and services, your use of the airpark and its facilities, and your participation in our text messaging program (together, the "Services").

By using the Site, submitting an inquiry or reservation, creating an account, or opting in to our text messages, you accept these Terms. If you do not agree, do not use the Services. Our Privacy Policy is incorporated into these Terms by reference.

1. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to reserve or purchase from us or to enroll in our text messaging program. If you create an account on the Site, you are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us immediately at info@westernskyairpark.com if you suspect unauthorized use.

2. Text Messaging Program (SMS / MMS / RCS)

This Section 2 governs the Western Sky Airpark text messaging program and is the complete messaging disclosure for the program.

2.1 Program Description

Program name: Western Sky Airpark Customer Notifications. Messages are sent from +1 928-543-1900. For questions by telephone, call our office on +1 928-732-3400.

By opting in, you agree to receive text messages from Western Sky Airpark Development LLC at the mobile number you provided. Messages are limited to the following types:

  • Customer care and support — replies to your questions and inquiries about lots, hangar homes, RV sites, fly-in and field access, water service, and other airpark matters, including two-way conversational messages.
  • Reservation and booking updates — RV site reservation confirmations, date or site changes, arrival and check-in information, and cancellation notices.
  • Account and billing notices — quotation and invoice notices, payment due reminders, payment confirmations, and water service billing notices.

We do not send marketing or promotional text messages under this program.

2.2 How to Opt In

You may enroll by any of the following methods:

  • Checking the SMS consent box on a form on our Site, including our contact form and our property and lot inquiry forms;
  • Checking the SMS consent box when you create an account on the Site, or in the contact details page of your customer portal account;
  • Giving your mobile number and consent verbally, in person or by telephone, to a Western Sky Airpark representative, who records the consent, the date, and the method in our system.

Consent to receive text messages is not a condition of purchasing or reserving any property, site, or service. You represent that the mobile number you provide is your own, or that you are authorized to consent on behalf of the subscriber, and you agree to notify us if the number is reassigned.

2.3 Message Frequency and Cost

Message frequency varies based on your reservations, your account activity, and your interactions with us. Message and data rates may apply. Any charges are billed by, and payable to, your mobile service provider. Contact your carrier for details about your plan.

2.4 How to Opt Out (STOP)

You may cancel at any time by replying STOP to any message you receive from us. You will receive a single message confirming your unsubscribe request, after which we will send you no further text messages. You may also opt out by emailing info@westernskyairpark.com or calling +1 928-732-3400. To rejoin, opt in again using any method in Section 2.2.

2.5 How to Get Help (HELP)

For help, reply HELP to any message, email info@westernskyairpark.com, or call +1 928-732-3400. Our team responds to help requests during regular business hours, Monday through Friday, Arizona time (MST — Arizona does not observe daylight saving time).

2.6 Carriers, Devices, and Delivery

Supported carriers include AT&T, Verizon Wireless, T-Mobile, US Cellular, Boost Mobile, MetroPCS, Cricket, and most other U.S. carriers. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed. Message delivery may fail for reasons outside our control, including network outages, roaming, an out-of-range or powered-off device, or an unsupported handset. You are responsible for maintaining a device capable of receiving text messages.

2.7 Privacy

Information collected through the text messaging program is handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

3. The Airpark, the Runway, and Prior Permission

Western Sky Airpark (FAA identifier 0AZ2) is a private airport serving its residents and invited guests. All nonresident landings require prior approval from airpark management; call +1 928-732-3400 before you launch. Landing and operating at the field is at the pilot's own risk, and by using the airpark's facilities you agree to hold Western Sky Airpark Development LLC, its management, and associated parties harmless from any liability, claims, or damages arising from that use. The full Landing & Usage Disclosure applies to every operation at the field and is incorporated into these Terms.

Field information published on the Site — runway dimensions, elevations, pattern altitudes, CTAF, weather, and webcam data — is provided for planning convenience, may change, and is not an official weather briefing or observation. Always consult current NOTAMs and official charts and confirm field conditions before flight.

4. RV Resort Reservations

RV site rates, availability, and site assignments are subject to change and are confirmed at booking. A deposit is required to hold a reservation. Cancellations made 7 or more days before arrival receive a full refund; cancellations made inside 7 days receive a 50% refund. Quiet hours are 9:00 p.m. to 6:00 a.m. Leashed pets are welcome. Full park rules and the guest disclosure apply to every stay, and we may decline or end a stay for conduct that endangers or unreasonably disturbs other guests, residents, or airpark operations.

5. Lots, Hangar Homes, and Owner Financing

Lot availability and pricing change and are subject to prior sale. Nothing on the Site is an offer to sell where prohibited. Lot boundaries shown on the Site are drawn from La Paz County assessor records for identification and marketing only; they are not a survey and do not establish boundaries, easements, or acreage. Refer to the recorded plat, your title report, and a licensed survey for authoritative information.

Lot sizes, layouts, amenities, renderings, timelines, and future development phases described on the Site are planning concepts and are subject to change and to county approvals; they are not guaranteed. Final lots, dimensions, and permitted uses are governed by the recorded plat, community design guidelines, and CC&Rs.

Owner-financing terms are available to qualified buyers on request, subject to review and applicable law. Nothing on the Site is a commitment to lend or an offer of credit. All binding terms of any purchase or financing are set out in the executed purchase agreement and related loan documents, which control over anything published on the Site. Western Sky Airpark supports the principles of the Fair Housing Act and Equal Housing Opportunity.

6. Water Service

Western Sky Airpark operates a private public water system under Arizona Department of Environmental Quality standards, serving airpark properties. Water quality testing results published on the Site are provided for the convenience of residents and prospective owners. Water service is billed separately, and amounts are payable in accordance with the terms shown on your bill. 7. Payment Terms

  • Quotations are valid for the period stated on the quotation and are subject to change and to availability. All orders and reservations are subject to our acceptance.
  • Prices are in U.S. dollars and exclude taxes and applicable fees unless expressly stated. Arizona transaction privilege tax and other applicable taxes may apply.
  • Invoices are payable in accordance with the terms stated on the invoice, order, or reservation.
  • Amounts not paid when due may accrue interest at the maximum rate permitted by Arizona law, and you are responsible for reasonable costs of collection, including attorneys' fees.
  • Returned or cancelled payments are subject to a charge equal to any bank or processor fee we incur.
  • We reserve the right to correct pricing, description, or availability errors and to cancel any affected order or reservation.

8. Property Owners Association

Western Sky Airpark Development LLC and the Western Sky Airpark Property Owners Association are separate entities. Sales, the RV Resort, water service, and field operations are handled by the Development company. Association dues, CC&Rs, architectural review, and resident governance matters are handled by the POA. These Terms govern your dealings with the Development company; they do not modify the CC&Rs or any POA governing document, which control in their own subject areas.

9. Site Content, Photos, and Renderings

Photographs, floor plans, 3D walkthroughs, and renderings on the Site may depict manufacturer models, optional features, or display finishes and are shown for illustration. Actual finishes, features, and construction may differ. Specifications, availability, and pricing described on the Site are subject to change without notice. Where the Site and an executed written agreement differ, the executed agreement controls.

10. Acceptable Use

You agree not to use the Services to violate any law; to infringe our or a third party's intellectual property; to transmit malware, spam, or unsolicited messages; to scrape, probe, or overload the Site; to attempt unauthorized access to any system or account; to access the airpark or its facilities without authorization; or to misrepresent your identity or authority. We may suspend or terminate access for any violation.

11. Intellectual Property

The Site and its content — text, graphics, logos, images, photography, video, maps, and software — are owned by Western Sky Airpark or its licensors and are protected by intellectual property laws. You may view and print content for your own internal, non-commercial use. Any other reproduction, distribution, modification, or commercial use requires our prior written permission.

12. Third-Party Links

The Site may link to websites and services we do not control, including mapping, weather, and video providers. We do not, directly or indirectly, imply approval, association, sponsorship, endorsement, or affiliation with any linked website unless expressly stated. Review the terms and privacy policy of any site you visit; your use of off-site pages is at your own risk.

13. Warranty Disclaimer

To the fullest extent permitted by law, the Site and the Services are provided "as is" and "as available", and Western Sky Airpark disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Where a manufacturer's warranty applies to a home or product, that warranty is passed through to you to the extent permitted by the manufacturer and is the only warranty that applies.

14. Limitation of Liability

To the fullest extent permitted by law, Western Sky Airpark and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, or property damage arising out of or relating to the Services, whether based in contract, tort, strict liability, or any other theory, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to the Services will not exceed the amount you paid to us for the property, site, or service giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in this section limits liability that cannot be limited under applicable law.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict of laws rules. You and Western Sky Airpark agree to the exclusive jurisdiction and venue of the state and federal courts serving La Paz County, Arizona, and waive any objection to that venue.

16. Changes to These Terms

We may update these Terms from time to time. Revisions take effect when posted on this page, and we will update the "Last Updated" date above. Your continued use of the Services after a change takes effect constitutes acceptance. Material changes to the text messaging program in Section 2 will be communicated to enrolled recipients where required by law or industry standards.

17. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy and the Landing & Usage Disclosure, are the entire agreement between you and Western Sky Airpark regarding the Services.
