REVISED RULES & REGULATIONS

Western Sky Airpark – “Permission to Land” Promotion

NO PURCHASE NECESSARY. PARTICIPATION REQUIRES PHYSICAL ARRIVAL BY AIRCRAFT.

1. SPONSOR & ADMINISTRATION

The “Permission to Land” Promotion (“Promotion”) is sponsored and administered by Western Sky Airpark Development LLC (“Sponsor” or “WSAD”), an Arizona limited liability company.

Sponsor reserves the right to interpret and enforce these Rules and Regulations. Any material changes to the Promotion will be posted on the Sponsor’s website.

2. PROMOTION PURPOSE

The Promotion is designed to encourage pilots to experience Western Sky Airpark by flying into the airport and sharing their experience through social media.

Participation in this Promotion does not constitute an offer to sell real estate.

3. ELIGIBILITY

Participation is open to individuals who:

• Are eighteen (18) years of age or older

• Are legal residents of the United States

• Are legally permitted to operate or occupy a general aviation aircraft

• Are legally permitted to own or lease real property in the State of Arizona

Employees, officers, managers, contractors, affiliates, and immediate family members of WSAD or the Western Sky Property Owners Association are not eligible.

Void where prohibited by law.

4. PROMOTION PERIOD

  The Promotion shall begin on February 1st 2026 and end on June 23rd, 2026, unless earlier terminated or extended by Sponsor.

5. HOW TO PARTICIPATE

To receive one (1) entry, an eligible individual must complete all of the following:

1. Register online at www.westernskyairpark.com

2. Fly a legally operated aircraft into Western Sky Airpark (0AZ2)

   
   

   • UNICOM: 122.9

   • Runways: 17 / 35 (3,500’ x 42’, paved)

   
   

3. Taxi and park the aircraft in the designated area near the official “Permission to Land” banner

4. Take a landscape-oriented photograph clearly showing:

   
   

   • The participant

   • The participant’s aircraft

   • The official banner

   
   

5. Like Western Sky Airpark on Facebook and Follow Western Sky Airpark on Instagram

6. Post the photograph to a public social media account (Instagram and/or Facebook)

7. Tag Western Sky Airpark and include #liveflythrive and #westernskyairpark

Limit one (1) entry per person.

6. NO CONSIDERATION

No purchase, payment, or fee is required to participate or win.

Social media activity required for entry is intended solely for promotional visibility and does not constitute consideration.

7. AVIATION OPERATIONS DISCLAIMER (FAA-SAFE)

Western Sky Airpark (0AZ2) is a private-use airport. All aviation operations are conducted solely at the risk of the pilot in command.

Participation in this Promotion:

• Does not grant priority, clearance, or special operating rights

• Does not modify standard airport procedures

• Does not relieve pilots of responsibility for safe operation

Each pilot remains solely responsible for compliance with all FAA regulations and accepted aviation practices.

8. ASSUMPTION OF RISK & HOLD HARMLESS

By participating, each participant knowingly and voluntarily assumes all risks associated with aircraft operations, ground movement, weather, terrain, wildlife, other aircraft, and presence on airport property.

To the fullest extent permitted by law, participants agree to release, indemnify, defend, and hold harmless Western Sky Airpark Development LLC, the Western Sky POA, and their respective affiliates from any claims arising out of participation.

9. PRIZE & ODDS

At least one (1) Prize will be awarded.

The Prize will consist of either:

• A residential lot, or

• A long-term ground or land lease (up to thirty (30) years, no extension)

The estimated odds of winning are approximately 1 in 1,500, depending on the total number of eligible entries received.

Sponsor reserves the right to award additional Prizes based on participation.

10. SELECTION OF WINNER

The winner(s) will be selected by random drawing from all eligible entries received during the Promotion Period.

The drawing will be conducted using a third-party online random selection platform, selected at WSAD’s sole discretion, to ensure fairness and integrity.

11. LOT / LEASE CONDITIONS & DISCLOSURES

Any awarded lot or lease shall be subject to:

• All recorded CC&Rs

• POA governing documents and bylaws

• Architectural and design standards

• Use of a builder designated by WSAD

• Applicable water connection fees

• Monthly assessments or lease fees

• Special assessments or surcharges

Any proposed transfer, assignment, or conveyance of an awarded lot or lease shall be subject to WSAD’s Right of First Refusal, which must be satisfied prior to approval of any transfer, to the extent permitted by the governing documents and Arizona law.

The awarded lot or lease may not be sold or transferred except as expressly permitted by WSAD and the governing documents.

12. DECLARANT RIGHTS & VOTING DISCLOSURE

Any lot or lease awarded shall be conveyed subject to all Declarant rights retained by WSAD, including, to the extent permitted by Arizona law and the governing documents, retention of POA voting rights associated with the lot.

13. TAXES & COSTS

Prize recipients are solely responsible for all taxes, fees, and costs associated with acceptance and use of the Prize.

14. PUBLIC DISCLOSURE

The name of the winner(s) may be announced on the Sponsor’s website and social media platforms. Winner information will be provided upon written request where required by law.

15. MODIFICATION & TERMINATION

Sponsor reserves the right to terminate or modify the Promotion if circumstances beyond its control compromise the integrity or intent of the Promotion. Any changes will be posted on the website.

16. GOVERNING LAW & VENUE

This Promotion is governed by the laws of the State of Arizona, with exclusive venue in La Paz County, Arizona.
